WEST VIRGINIA STATEWIDE ADDRESSING AND MAPPING BOARD DATA DISTRIBUTION POLICY

Status of Data Development

The West Virginia Statewide Addressing and Mapping Board (SAMB) will generate geospatial data as the result of two discrete efforts. The first is the contract SAM-0202 by which the State was photogrammetrically mapped to include color aerial photography film), digital elevation data suitable to produce elevation surfaces able to generate approximate 10 ft contours, color digital orthophotography, and various planimetric mapping features. The SAMB's Project Manager intends to perform quality control and quality assurance then final certification of the mapping data products. Each of West Virginia's 55 counties will be provided with a complimentary digital copy of the information for their county with single 25,000 ft. map-tile buffer into the adjacent county boundaries subject to the limitations and restrictions of this policy. The milestone for completion of this effort is estimated to occur in September 2004.

The second effort is the addressing contract SAM-0301. This effort will result in many enhancements to the planimetric data including: additions of features based on terrestrial GPS surveys, database attribution of road centerlines with address ranges and road names among other standard features identified in the NENA standards for road centerlines, building features will be attributed with additional information necessary to produce E9-1-1 databases. Again, the SAMB's Project Manager intends to perform quality control and quality assurance then final certification of the addressing data products. Each of West Virginia's 55 counties will be provided with a complimentary digital copy of the tabular and revised geometric data clipped to county boundaries, subject to the limitations and restrictions of this policy. Each county will also receive interim copies of data to use in assisting the addressing contractor with things like road naming, emergency service zone (ESZ) delineation, and addressing (again, subject to the limitations and restrictions of this policy).

Policy Statement

This policy is a living document. It will evolve as the Project proceeds. This policy will be incorporated in SAMB's legislative rules when sufficiently evolved and definitive to be proposed to the Legislature. SAMB's Project Manager and counsel are directed to propose changes to the policy on a going-forward basis as may be appropriate.

The SAMB may at its discretion, distribute data to other federal, state or local agencies under license or intergovernmental agreement. The SAMB may in so doing seek to obtain additional funding to perform tasks that will clearly enhance the Project and therefore the mission of the SAMB. Appropriate license agreements are to be used, on a case-by-case basis.

SAMB will distribute maps and other data of the Project on a tiered basis. That is, SAMB will distribute data to 9-1-1 centers free of charge, with only protections against liability and against further, unauthorized distribution. SAMB will make the data available to other agencies on barter or other SAMB-approved arrangement pursuant to intergovernmental agreements. Except as otherwise stated in this policy for privacy, homeland security or other concerns, data is to be made available to the public under special partnering arrangements or at competitive prices, aimed at allowing the distribution of the data in a manner that benefits the safety, health and welfare of the citizens of West Virginia and its economy.

SAMB data will not be distributed except as expressly authorized by SAMB, and only under appropriate license agreements approved by SAMB counsel. SAMB counsel is authorized to make technical changes to standard license agreements from time to time under the supervision of the SAMB Executive Committee and with the consent of the Project Manager. Any substantial changes must be approved first by SAMB.

The Project Manager is directed to work with SAMB counsel to develop contracts as requests may arise. Such contracts may range between "you-pay-full-price" licenses for full distribution rights to "you-pay-little" for no distribution rights.

The Project Manager and SAMB counsel are directed to research licensing policies of other states and of national licensing organizations, such as the NRC Licensing Committee at

The Project Manager and SAMB counsel will make recommendations based on their research.

• In selecting the appropriate price points for the data, SAMB will rely on the advice of its Project Manager, and upon any appropriate market research and analysis, as may be recommended by the Project Manager.

• SAMB intends to allow Internet distribution and/or ordering of the data, on a user-friendly site, as may be recommended by the Project Manager. The Project Manager is to design and implement that e-commerce site, at the appropriate time frame in the progress of the Project.

• SAMB will deliver the 9-1-1 ALI data to the county commissions and other authorized users free of charge as required by law. The data will be delivered under a license agreement limiting its further distribution for other than 9-1-1 emergency purposes until such time as SAMB sunsets and the data stewardship is transferred to the county commissions under the oversight of the WV PSC, which will have the stewardship provided by law over the necessary rules related to the use and distribution of the data.

• All necessary addresses are to be delivered to the United States Postal Service ("USPS") free of charge.

• SAMB may in its discretion enter into cooperative agreement with other agencies, including the Rahall Appalachian Transportation Institute ("RTI") at Marshall University and the GIS Center at West Virginia University ("WVU"), regarding the distribution of data, if in the best interest of the safety, heath and welfare of the citizens of the State of West Virginia.

• Unless SAMB expressly specifies otherwise, wireline and wireless ALI-type information (that is, information that contains the name, address/location and telephone number) is to be kept confidential in order to protect privacy and homeland security.

• Unless SAMB expressly specifies otherwise, no attributes on specific structures are to be released publicly. · SAMB may in its discretion consider the release of data for academic research or educational purposes on a case-by-case basis.

• Any funds received from data distribution are to be used to enhance the Statewide Addressing and Mapping System, with improving 9-1-1 emergency dispatch as a priority.

• Data is not to be released prematurely. The Project Manager is to provide final technical approval and advise SAMB as to when data should be made available for release.

• In making any decision on whether to release data, SAMB intends to take into account the safety, health and welfare of the citizens of the State of West Virginia and its economy. The promotion of 9-1-1 emergency dispatch, however, is to be a priority.

• The protections for privacy and homeland security in SAMB's legislative rules are to be followed in all cases.

• In no event may SAMB be liable resulting from the distribution of data. SAMB counsel is directed to take appropriate action, under the supervision of the Executive Committee, in order to implement this policy.

• Under all circumstances, data distribution is to be consistent with the directives of the Legislature and the laws of the State of West Virginia.
